That I Peter Schell formerly of Boston in the County of Suffolk State of Massachusetts now resident of Philadelphia State and County of Pennsylvania in consideration of Thirty Thousand Dollars paid by John Taylor and Thomas A. Taylor both of Boston aforesaid the receipt whereof is hereby acknowledged do hereby give grant bargain sell and convey unto the said John Taylor and Thomas A. Taylor their heirs and assigns forever a certain lot of land with the buildings thereon standing situate in said Boston and numbered 855 and 857 Washington St being bounded easterly by Washington St one hundred and twenty six feet more or less southwesterly by a passage way called Lavery Passage from Pine Street bounded south easterly by Harrison St then measuring south westerly by land now or formerly of Robert Davis one hundred and fifty eight feet more or less now or formerly of Nose is the Passage way aforesaid then measuring sixty five feet then turning and running south westerly and bounded north easterly by the south easterly side of said passage way (the same being twelve feet in width ) one hundred and fifty feet more or less to the point of beginning containing five thousand one hundred and fifty five square feet more or less is conveyed together with a right of way to said Taylor's and their heirs and assigns in said Passage way forever To have and to hold the above granted premises with all the privileges and appurtenances to the same belonging to the said John and Thomas A. Taylor their heirs and assigns to their own use and behoof forever And I the said grantor for myself and my heirs executors and administrators do covenant with the said grantees and their heirs and assigns that I am lawfully seized in fee simple of the afore granted premises that they are free from all encumbrances that I have good right to sell and convey the same to the said grantees and their heirs and assigns forever as aforesaid and that I will and my heirs executors and administrators shall warrant and defend the same to the said grantees and their heirs and assigns forever against the lawful claims and demands of all persons. In witness whereof I the said Peter Schell and Catharine my wife in token of her release of all her right of dower in the above premises have hereunto set our hands and seals this fourth day of March in the year of our Lord one thousand eight hundred and sixty one. The following is a copy of an original mortgage deed from
Joseph Barrows to Abram Rogers dated June 17th 1809
recorded in Lib 230 fol 218.
The undersigned Theophilus Sanderson and
Tom Bentley both of Boston hereby certify that on four
month of April 1809 we increased Main Obam Rogers the within
mortgagee enter upon and take quiet and peaceable possession
of the within described premises and while upon the premises
took turf and twig in the name of the whole for the purpose of
foreclosing the mortgage for breach of the condition thereof according to law and
William B. Waldman was present and witness the same.
Boston April 1st 1809 Then personally appeared the above named

Know all Men by these Presents that we James Guild Francis Guild and Henry Guild of Boston in the County of Suffolk and Commonwealth of Massachusetts administrators of the estate of Daniel Franklin Child late of said Boston deceased with will annexed (authority to sell having been granted by the Probate Court for said County of Suffolk on the twenty ninth day of February A.D. 1883) in consideration of eight thousand dollars to me paid by Peter Schell of said Boston the receipt whereof is hereby acknowledged do hereby give grant bargain sell and convey unto the said Peter Schell his heirs and assigns a certain parcel of land situated on Washington Street and Olive Place in said Boston bounded as follows viz Beginning at the southwesterly corner of said Olive Place and Washington Street there measuring southwesterly on Washington Street one hundred twenty one (121) feet to a point at the northerly line of a passage way twelve (12) feet wide there turning and running southeasterly on said passage way one hundred fifty (150) feet more or less to the easterly line of a passage way twelve (12) feet wide there turning and running southwesterly on said passage way twenty one (21) feet more or less to the northerly line of land now or late of Mary J. Thayer there measuring twenty one (21) feet more or less on said Thayer's land there turning and running northeasterly on said Thayer's land one hundred twenty one (121) feet more or less to Washington Street the point of beginning containing twenty one thousand six hundred (21600) square feet more or less. Said Lot is shown on a plan dated January 10, 1870 by J. Franklin Fuller Civil Engineer and Surveyor recorded with Suffolk Deeds Book 1009 page 219 to which reference is hereby made for a more particular description of said lot. The said granted premises are conveyed subject to the restrictions contained in a deed from Charles Thayer to Peter Schell dated June 29, 1870 recorded with Suffolk Deeds Book 1009 page 218 which restrictions are as follows viz "The grantee herein his heirs and assigns shall not erect or permit to be erected on the said granted premises any building more than forty (40) feet high measured from the mean level of the curb stones on Washington Street and Olive Place" And also subject to the party wall agreements contained in said deed. To have and to hold the granted premises with all the privileges and appurtenances thereto belonging to the said Peter Schell his heirs and assigns to their own use and behoof forever. And we the said administrators do covenant with the said grantee his heirs and assigns that we are lawfully seized in fee of the aforegranted premises that they are free from all encumbrances that we have good right to sell and convey the same to the said grantee his heirs and assigns forever and that we will and our successors shall warrant and defend the same to the said grantee his heirs and assigns forever against the lawful claims and demands of all persons. - Last Will and Testament of Peter Schell, dated December 4, 1899.
Be it remembered that I Peter Schell Paper Baker of Boston in the County of Suffolk in the Commonwealth of Massachusetts, being of sound mind and memory but knowing the uncertainty of this life, do make this my last will and testament, revoking all former wills. After the payment of my just debts and funeral charges I bequeath and devise as follows.
To Peter C.Schell, my son, all the Real Estate at 1354 and 1358 Washington St Boston, together with all the personal property connected therewith consisting of horses, carriages, carts, furniture, fixtures, the good will in the business, all stock in trade in the same now used in part as a Bakery and dwelling house. I direct appoint him said Peter to, my son, Executor of this my will requesting that he is not required to give a bond.
I direct that my said son Peter is as soon as my death as may be pay to Katie Luppold my daughter, wife of Frank Luppold, now residing in Germany. Five Thousand ($5000) dollars out of his Peter C's share above estate, which with the amount that I have heretofore given her I believe her fair share.
To Mary Ann Rice, my daughter, wife of Joseph Rice, six thousand dollars ($6000) out of my Homestead at 1224 + 1226 Washington St Boston, or if she prefers and elects to retain said 1224 + 1226 property she shall pay to Josephine M. Schuler, my daughter, wife of Mathias Schuler, six thousand dollars ($6000) as soon after my death as may be.

After my death if said property should bring less than that amount and if Mrs Rice should decline to buy it and pay $6000 to Mrs Schell. After my death and the death of my wife I direct that said property at 1224 + 1226 Washington St Boston and all the property above the sum of $6000 first to be paid to Mrs Rice the balance of said amount be divided equally between the children of said Mrs Rice and Mrs. Schell sons of my deceased son as Mrs Schell has already had six thousand and Mrs Rice nothing. The following: Martha Rice, Burwell Rice, Louis U. Schell, Dorinda Schell, Bellevue Schell, Mary G. Schell, Frank J. Schell, Robert J. Schell, Virgil J. Schell, Walter J. Schell, Mary Th. Burnham, Eliza J. Willard, Susan Schell, Eliza D. Schell. I direct that as long as my wife lives she shall be provided for out of my said estate as she directs and desires for her comfort and support. In testimony whereof I hereunto set my hand and in the presence of three witnesses declare this to be my last will this 4th day of December in the year one thousand eight hundred and ninety nine.
