acknowledged do hereby give grant bargain sell and convey unto the said Peter Schell a certain piece of land with the buildings thereon standing situate in said Boston and numbered 855 and 857 Washington St being bounded easterly by Washington St one hundred and twenty six feet more or less southwesterly by a passage way called Lavery Passage from Pine Street bounded south easterly by Harrison St then measuring south westerly by land now or formerly of Robert Davis one hundred and fifty eight feet more or less now or formerly of Nose is the Passage way aforesaid then measuring sixty five feet then turning and running south westerly and bounded north easterly by the south easterly side of said passage way (the same being twelve feet in width ) one hundred and fifty feet more or less to the point of beginning containing five thousand one hundred and fifty five square feet more or less To have and to hold the granted premises with the privileges and appurtenances thereto belonging to the said grantee his heirs and assigns to his and their own use forever And we the said grantors for ourselves our heirs executors and administrators do covenant with the said grantee his heirs and assigns that we are lawfully seized in fee of the afore granted premises that they are free from all encumbrances that we have good right to sell and convey the same to the said grantee his heirs and assigns forever as aforesaid and that we will and our heirs executors and administrators shall warrant and defend the same to the said grantee his heirs and assigns forever against the lawful claims of all persons Provided nevertheless that if the said grantors or their heirs executors or assigns shall pay unto the said grantee or his executors administrators or assigns the sum of Thirty thousand dollars on or before the first day of March 1810 with interest on said sum at the rate of six per centum per annum payable semi annually and also pay all taxes levied or assessed upon or for said premises from this date as also deliver certain promissory notes bearing date March
1st 1809 signed by the said John and Thomas A. Taylor
the sum of Thirty Thousand dollars being the full consideration
money mentioned in the within deed Peter Schell
To all persons to whom these presents shall come I John H. French
Justice of the Peace in and for the county of Suffolk in the
Commonwealth of Massachusetts do hereby certify that on the
first day of March 1809 personally appeared before me the subscriber John Taylor and Thomas A. Taylor the grantors in the
within instrument named and acknowledged the within instrument to be their free act and deed In testimony whereof I have hereunto set my hand the day and year above written Jno. H. French Justice of the Peace
The following is a copy of an original mortgage deed from
Joseph Barrows to Abram Rogers dated June 17th 1809
recorded in Lib 230 fol 218.
The undersigned Theophilus Sanderson and
Tom Bentley both of Boston hereby certify that on four
month of April 1809 we increased Main Obam Rogers the within
mortgagee enter upon and take quiet and peaceable possession
of the within described premises and while upon the premises
took turf and twig in the name of the whole for the purpose of
foreclosing the mortgage for breach of the condition thereof according to law and
William B. Waldman was present and witness the same.
Boston April 1st 1809 Then personally appeared the above named
Theophilus Sanderson and Tom Bentley and made oath that
they did on the first day of April 1809 enter upon the premises
described in the within mortgage and in the presence of
William B. Waldman take quiet and peaceable possession thereof for the purpose of
foreclosing the mortgage for breach of the condition thereof as above set forth Before me Jno. H. French Justice of the Peace
